A 46-year-old man was arrested on reckless endangerment charges, and authorities are investigating whether the boat was an illegal charter.

The operator of a boat that overturned near the Statue of Liberty, killing a woman and a baby, has been arrested and charged with reckless endangerment, New York police said.

The boat's captain, 46-year-old Manuel Hernandez of Midtown Manhattan, was arrested early Sunday and charged with 13 counts of reckless endangerment.

Twelve people were rescued from the water after a large search and rescue operation, police say.
