President Donald Trump's administration on Monday released a proposed regulation ​to codify an unprecedented fee of more than US$100,000 on new H-1B visas for highly skilled foreign workers that has been blocked ‌by the courts.

The proposal by DHS comes just an earlier $100,000 H-1B visa fee — which was announced by Donald Trump as a presidential proclamation in September 2025 and subsequently halted by a US court in June this year — is set to expire on Sept 21
