Brazil’s Top Court Lets Pretrial Detention Count Toward January 8 Sentences

Brazil's Supreme Federal Court has ruled that time spent in pretrial detention counts toward the sentences of people convicted over the January 8, 2023 attacks. Reached on August 6, 2026, the decision also credits time under a form of home confinement, going further than the reporting justice, Alexandre de Moraes, had proposed. Nominal sentences do not shrink, but the recalculated time served could let some convicts progress or finish sooner.
